These Terms govern your use of DialSwarm / AutoSDR (the "Service"). By creating an account, accepting consents in-app, or placing calls, you agree to them. This is not legal advice.
DialSwarm lets you configure AI voice agents that place outbound phone calls on your behalf. You provide the numbers to call and the content of the pitch. You control who gets called. Calls may use artificial, prerecorded, or cloned voices.
Calls may be recorded and transcribed. U.S. states differ: some allow recording with one party's consent; others require all-party (two-party) consent. You are responsible for knowing the rules that apply to each call and for giving any legally required notice that the call is being recorded. Checking the in-app recording-consent box does not replace your legal obligations.
Recipients may be speaking with an AI agent or a voice clone. You are responsible for any legally required disclosure that the caller is AI or uses a synthetic/cloned voice. Do not use the Service to impersonate a person or organization you are not authorized to represent, or to deceive recipients about who they are speaking with.
You may not use the Service for: unlawful, deceptive, or harassing calls; robocalls or blast dialing without a lawful basis; spam; scams, spoofing, or fraud; calling numbers on DNC lists you are not exempt from; or any use that violates our providers' policies (telephony / voice AI). We may suspend accounts that do.
Custom voice cloning requires documented, verifiable consent from the person whose voice is cloned. See Voice Consent & Release.
Free plans include a limited number of trial calls (default: 5). Paid plans and add-ons (extra numbers, extra agents, Pro unlimited) are billed as displayed in-app, typically via PayPal or Cash App. Fees are non-refundable except where required by law. Entitlements (numbersIncluded, agentsPurchased, etc.) are stored on your account record.
We retain account data, call logs, transcripts, and recordings while your account is active so you can review history. You may request deletion; we may retain records as needed for law, disputes, or abuse prevention. See Privacy Policy.
The Service is provided "as is." AI agents can make mistakes; you are responsible for reviewing outputs and outcomes. We do not guarantee call connection, deliverability, recording availability, or sales results.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for claims arising from your calls, your content, your compliance failures, or third-party networks. Our total liability is limited to the amount you paid us in the prior three months (or $0 if you are on a free plan).
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your calls, your content, or your violation of law or these Terms (including TCPA, recording-consent, and DNC claims).
The Service is for business users age 18+. It is not directed to children under 13 (or under 18 for account creation).
We may update these Terms and will post the new date above. We may suspend or terminate accounts that violate these Terms. You may cancel at any time.
Product gates and checkboxes are compliance aids, not a substitute for counsel. Have a lawyer review your outbound program before scale.
